Referendum on homosexual unions moves forward in Ecuador
Ecuador - The possibility of conducting a national referendum to decide on civil unions for homosexuals
remains open, after the Supreme Electoral Tribunal rejected an appeal by groups who favor that this option
be decided by legislative means.

The judges of the Supreme Electoral Tribunal (TSE) rejected the "amparo election," presented by the
Diversity Movement Association for Human Rights and Health, which considers unfair to subject the will of
the majority popular approval or denial of new guarantees for a social minority group.

The request for referendum by opponents of the bill, which enjoys a good atmosphere in Congress and the
executive branch, received the preliminary approval of the TSE and the office of the Legislative Assembly.

The next phase is the preparation of official forms so that the proponents of the referendum may attempt to
collect some 135,000 signatures needed for consideration(5% of voters). That is the minimum amount to
comply with the law to consider the referendum requested by the citizens' initiative.

Religious groups, both Catholics and other denominations, maintained strong opposition to the project that
would give homosexuals the right to obtain pensions for couples, receive and leave inheritances and
acquisitions fees, like any heterosexual marriage.

Two lawyers opposed to the legal reform prompted the referendum, with the intention that most people keep
the current legislation.

The consideration should take place before next August or after August 2010. It would be the second of its
kind, after the referendum on the FTA in October 2007.

Avanza el referendo sobre uniones homosexuales en Ecuador

Ecuador - La posibilidad de realizar un referendo nacional para decidir sobre las uniones civiles de
homosexuales se mantiene abierta, después de que el TSE rechazó una apelación de grupos favorables a
que esa opción se decida por vía legislativa.

Los magistrados del Tribunal Supremo de Elecciones (TSE) rechazaron el “recurso de amparo electoral”
presentado por la Asociación Movimiento Diversidad pro Derechos Humanos y Salud, que estima injusto
someter a la voluntad de la mayoría popular la aprobación o denegación de nuevas garantías para un grupo
social minoritario.

La solicitud de referendo, presentada por opositores al proyecto de ley —que goza de buen ambiente en el
Congreso y en el Poder Ejecutivo—, recibió el aval preliminar del TSE y de la oficina correspondiente de la
Asamblea Legislativa.

La fase siguiente es la orden de confección de formularios oficiales para que los proponentes de la
consulta popular recojan unas 135.000 firmas (5% del padrón electoral). Esa es la cantidad mínima para
cumplir con lo que la ley manda para los referendos solicitados por vía de iniciativa ciudadana.

Grupos religiosos, tanto católicos como de otras denominaciones, mantienen una fuerte oposición al
proyecto que daría a los homosexuales el derecho a obtener pensiones de pareja, recibir y dejar herencias
y cobrar derechos gananciales, como cualquier matrimonio de heterosexuales.

Dos abogados opuestos a la reforma legal impulsaron el referendo, con la intención de que la mayoría
popular mantenga la legislación actual.

La consulta debería realizarse antes de agosto próximo o después de agosto del 2010. Sería la segunda de
este tipo, después del referendo sobre el TLC en octubre del 2007.
