the suspicion or rumor they are gay. Moreover, although many
gay men, lesbians, and bisexuals try strenuously to keep their
sexual orientation a secret, such information may be divulged
inadvertently through a co-worker overhearing a private
telephone conversation or through a co-worker disclosing to
others information initially told in confidence. Regardless of all
that, it runs counter to basic values of fairness and equality that
we as a nation hold so dear to force someone to actively hide
their sexual orientation or gender identity.
ENDA will protect lesbian, gay, bisexual, transgender (LGBT), as
well as heterosexual, employees from discrimination in the
workplace based on their actual or perceived sexual orientation
or gender identity.

The majority of Americans believe employment decisions should be based on a
person’s qualifications and work ethic. Discrimination in the workplace due to a
person’s real or perceived sexual orientation or gender identity goes inherently against
our American values.
I am a lead sponsor of the Employment Non-Discrimination Act (ENDA), which extends
federal employment discrimination protections to include sexual orientation and
gender identity. This bill will make a profound difference in the lives of many individuals
and families.
Every year, qualified hard-working Americans in both public and private sector
workplaces are denied job opportunities, are terminated, or experience on-the-job
discrimination because they are lesbian, gay, bisexual or transgender. Yet there is no
federal law prohibiting discrimination on the basis of sexual orientation or gender
identity. As a result, in 29 states it is legal to discriminate based on sexual orientation,
and in 38 states discrimination based on gender identity is legal. ENDA is a common-
sense remedy for this unfair situation.
Nearly 90% of Americans believe that lesbians and gays should
have equal rights in job opportunities. Even when gay men,
lesbians, or bisexuals never mention their sexual orientation at
work, they face the possibility of harassment or firing based on
passage of this bill will help the countless people looking to live out their lives secure in the fact
that a high-quality job will not be denied to them due to their sexual orientation or gender identity.

This legislation does not prevent employers from firing lazy or incompetent employees. It simply
gives all Americans a fair opportunity to work hard to get ahead without discrimination or bias. It
reflects a bedrock American principle that working men and women should be judged solely on
the basis of their job performance.
Twenty-one states and the District of Columbia have laws protecting gay, lesbian, and bisexual
people from employment discrimination and 12 states and the District of Columbia have laws
that also protect transgender people.
It is time to make this a federal protection. I have been active in the pursuit of equality and fairness
under the law. Everyone deserves equal treatment and protection under our laws and our
